employed.im Terms and Conditions

PDMS Limited reserves the right to amend these policies on occasion.

Please review the site regularly to ensure that you are up to date with changes.

General 

a) employed.im is a careers, skills, work experience and networking portal for individuals and organisations.

b) employed.im is wholly owned and administered by PDMS Limited (PDMS).

c) references to employed.im or PDMS shall, where relevant, be deemed to be references to both;

d) employed.im reserves the right to amend these terms and conditions at any time.

e) Accordingly, employed.im will notify all members when the terms and conditions change, however, it is recommended that members of employed.im review the terms and conditions regularly to ensure that you are familiar with the latest version.

f) All persons who view employed.im will be considered users of the system. A user will become a member when they register for an account on employed.im. Certain individuals may be granted administrative privileges by an organisation or membership, and as such become administrative members for that organisation or membership.

g) employed.im reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the system (or any part thereof) with or without notice. Members agree that employed.im, shall not be liable to the member or any third party for any such modification, suspension or discontinuance of our system.

User responsibilities

a) employed.im is open to anyone over the age of 13, although persons under the age of 16 will have their profile set to only be visible to themselves and will not be able to amend this until they reach the age of 16.

b) By registering with employed.im members certify that the details entered are their own and that they will not register, submit personal information or apply for a vacancy on behalf of any other party.

c) Members are responsible for the accuracy of the personal information that they submit into their profile.

d) Members must not submit documents into their profile which attempt to advertise or promote any product or service.

e) Members must not knowingly submit documents that contain viruses, malicious or harmful code.

f) employed.im accepts no responsibility for any content that a member downloads from the site which has been provided by a third party, e.g. viruses, offensive material. All content downloaded from the site is done so at the risk of the member. Should a member find content in the downloaded material which they feel is inappropriate, offensive or contains malware, they should report this immediately to admin@employed.im, or via the ‘Contact Us’ link on the site so that we can investigate, and where necessary, remove the material from the site.

g) Members must not use employed.im for any unlawful purpose or any illegal activity, or post or submit any content, CV, or vacancy that is defamatory, libelous, implicitly or explicitly offensive, vulgar, obscene, threatening, abusive, sexually explicit, hateful, racist, discriminatory, of a menacing character or likely to cause annoyance, inconvenience, embarrassment, anxiety or could cause harassment to any person, or include any links to pornographic, indecent or sexually explicit material of any kind, as determined by employed.im’s discretion.

h) Members are responsible for maintaining the confidentiality of their account, profile and passwords, as applicable. Members should not share their password or other account access information with any other party and shall be responsible for all uses of their login and password, whether or not authorised by the member. If a member suspects that their password has become known by someone else, they should immediately change their password via the link on the website, and if they feel it is necessary, report the situation to admin@employed.im.

i) The nature of this site is such that employed.im do not have control over the content entered by users or organisations, and therefore do not have any responsibility for this content. employed.im will periodically monitor the content of the site, but if you see anything on the site which you consider to be inappropriate or offensive please report it to the employed.im administration team via the ‘Contact Us’ link on the website, or by email to admin@employed.im.

j) Users may encounter content or information that might be inaccurate, incomplete, delayed, or misleading. employed.im does not normally review content provided by our users therefore we are not responsible for third parties' (including other users) content or information or for any damages as result of a user’s use of or reliance upon it.

k) employed.im accept no responsibility for any material that a member uploads which is subject to a copyright infringement. In such instances the responsibility remains with the member who uploads such material. Whereemployed.im are notified of material that breaches copyright, the material will be removed from the system.

l) Members may encounter content or information that might be inaccurate, incomplete, delayed, or misleading. employed.im does not normally review content provided by our members therefore we are not responsible for third parties' (including other members) content or information or for any damages as result of a member’s use of or reliance on it.

m) Any member found to be in breach of these terms and conditions may have their account deleted byemployed.im, and in serious cases may face prosecution.

n) employed.im facilitates messaging and sharing of information in many ways, such as your profile, vacancy listings and direct private messages. Information and content that you post may be seen by other members, organisations, visitors or groups. employed.im accepts no liability for any shared information or what it may expose.

o) Activities, such as applying for an advertised vacancy or sending a direct message, are by default private and only visible to the addressee(s).

p) employed.im may, from time to time, contact members regarding changes to the terms and conditions and with information regarding enhancements to the service.

q) employed.im may also contact members from time to time to notify them of vacancies that meet criteria that they select. These communications will only occur when members provide their consent to receiving them. Should members wish to opt out of these communications an option is available from within ‘Preferences’ of the ‘Account’ section, or they should contact the employed.im administration team via the ‘Contact Us’ link on the website.

Organisations Responsbilities

a) Organisations can be represented on employed.im in order to advertise vacancies and other careers opportunities and events that they wish to promote.  It is open only to organisations with an Isle of Man based presence.

b) All requests for organisations to join employed.im must be made by individuals who are directly associated with that organisation. 

c) All requests for organisations to join employed.im will be reviewed byemployed.im, who reserve the right to contact the organisation for further information if necessary.  employed.im will not refuse an organisation’s request to join the site without a justifiable reason. 

d) employed.im reserve the right to refuse or terminate an existing account at any time if the applicant is found to not have an Isle of Man based presence.

e) It is recommended that organisations that are setup on employed.im have at least one nominated member who is designated as their ‘administrator’.  These members will be assigned rights allowing them to post to the site on behalf of the organisation.  It is expected that these members will be current employees of the organisation.

f) Should the organisation wish to change a nominated administrator, this should be done by an existing administrator or the previous administrator.  If a company has only one administrator, the new administrator should then revoke the administrative privileges of the previous administrator.  Should this not be possible, then the organisation should contact the employed.im administration team, via the ‘Contact Us’ link on the website, who will be able to make the desired changes.

g) The organisation, and its nominated administrator(s), must not post any vacancy which is not in accordance with Isle of Man employment legislation.

h) The organisation, and its nominated administrators, must not use employed.im for any unlawful purpose or any illegal activity, or post or submit any content, or vacancy that is defamatory, libelous, implicitly or explicitly offensive, vulgar, obscene, threatening, abusive, hateful, racist, discriminatory, of a menacing character or likely to cause annoyance, inconvenience, embarrassment, anxiety or could cause harassment to any person or include any links to pornographic, indecent or sexually explicit material of any kind, as determined by employed.im’s, discretion.

i) Organisations, through the system, have the ability to create personalised URL’s for their vacancies.  These URL’s will then link to the companies’ page on the system.  employed.im reserve the right to review and approve all URL’s prior to their use in order to ensure that they are deemed acceptable e.g. do not contain any words that might cause any of the emotions detailed in clause 3 (h).

r) The organisation, and its nominated administrators, are responsible for maintaining the confidentiality of their account, profile and passwords, as applicable.  They should not share passwords or other account access information with any other party and shall be responsible for all uses of the login and password, whether or not authorised by the organisation.  If it is suspected that the password for the organisations administrator has become known by someone else, it should immediately be changed via the link on the website and if they feel it is necessary, report the situation to admin@employed.im. 

j) If a vacancy is advertised as being available to members under the age of 16 it must be in accordance with the terms of the Education Act 2001 and the Employment of Children Regulations 2005.

k) Any organisation found to be in breach of these terms and conditions may have their account deleted by employed.im, and in serious cases may face prosecution and/or face libel charges.

Membership responsibilites

a) Membership is open only to trade organisations and charities with an Isle of Man based presence.

b) A membership is categorised as a collection of organisations or individuals for example a trade association, or trade union.

c) Memberships have the ability to contact their associated members and or organisations through employed.im

d) Memberships can be represented on employed.im in order to advertise accreditations to a trade organisation, contact groups of organisations or individuals with regards to work related activities, or any other work-related activity as prior agreed by employed.im.  It is open only to organisations with an Isle of Man based presence.

e) All organisations that request the ability to grant memberships will be reviewed by employed.im, who reserve the right to refuse the application.  employed.im may also need to contact the organisation for further information if necessary.  employed.im will not refuse an organisation’s request for membership without a justifiable reason. 

f) employed.im reserve the right to and to refuse or terminate an existing account at any time if the applicant is found to not have an Isle of Man based presence.

External websites

a) employed.im includes links to external sites, some of which have been made with the permission of the external site owners.  employed.im are not responsible for the content, availability or quality of material contained on external sites.

b) Members are responsible for complying with the terms and conditions of use of any external sites that they access via employed.im.

Vacancy policy

a) employed.im does not operate a placement service and does not guarantee responses to advertisements placed on this website.

b) Any vacancies posted on employed.im must be done so in accordance with these Terms and Conditions.

c) employed.im reserve the right to remove any vacancy or content at any time should it feel that it infringes these terms and conditions.

Use of Information 

a) employed.im will only process members information in accordance with the Privacy Policy.

b) Information in employed.im may also be used for:

Academic study purposes

Any such use will adhere to BERA (British Educational Research Association) guidelines, as detailed in the ‘Ethical Guidelines for Educational Research (2011)’ publication.  In essence, anonymous information may be used to study patterns of website use. 

Personal information will be used for academic purposes only a) with the explicit, voluntary, informed consent of the member and b) when that personal information has been made anonymous.

Statistical reporting

Data recorded on employed.im may be used for statistical reporting, for example to provide information on the number of application forms that have been submitted through the site or the number of jobs advertised in various sectors.  The purpose of this information is to provide useful information on the labour market. It will always be depersonalised.

c) Please note that employed.im may use third party reporting such as Google Analytics to obtain general information about browsing patterns and demographics.  This does not use registration data from employed.im, or any personal identifying information. Security 

a) PDMS have undertaken appropriate security measures to protect (with reasonable commercial endeavor) against the misuse, loss or alteration of information that members, organisations and memberships have provided.

a) Unless otherwise stated, all material on the employed.im Internet site (excluding text and images uploaded by members and organisations), is Copyright © 2001-2018 PDMS Ltd, (including text, artwork, graphics, layout, and icons).  This material cannot be copied or used in any way, without permission from PDMS Limited.

Disclaimer

Jurisdiction

a) These Terms and Conditions will be governed by the laws of the Isle of Man and by registering with employed.im you consent that any action in relation to this membership will fall under the jurisdiction of the courts of the Isle of Man.
